Terms of Service
Last updated: October 8, 2026
These Terms of Service (“Terms”) apply to the website and travel advisory services of LuxeAway LLC (“LuxeAway,” “we,” “us,” or “our”). “You” means the person using our website or engaging our services.
1. Our Services
LuxeAway provides private travel advisory, planning, and booking services. New client engagements are generally welcomed through personal introduction and are subject to our acceptance and availability. Submitting an inquiry does not create a booking or require either party to proceed.
Our website presents our services and illustrative travel ideas. Featured itineraries, photographs, descriptions, and estimated prices are for inspiration and information unless expressly incorporated into your confirmed booking. Availability, inclusions, and pricing must be confirmed before booking.
Travel services, including accommodations, transfers, cruises, yacht charters, excursions, and event access, are generally supplied by independent third-party providers (“Travel Suppliers”). Your booking documents will identify the arrangements included in our services and any applicable exclusions.
2. Acceptance and Changes to These Terms
By using our website, you agree to the provisions of these Terms applicable to website use. Before engaging our travel services, you will be provided with these Terms and the relevant booking documents for acceptance. An inquiry alone does not constitute acceptance of a travel booking or authorization to incur charges.
We may update these Terms for future website use and bookings. The version provided to and accepted by you when booking will govern that booking unless we mutually agree otherwise in writing or a change is required by law. Updated website terms do not automatically alter an existing booking.
3. Traveler Information and Group Bookings
You must be at least 18 years old and have legal authority to engage our services. If you request or authorize arrangements for other travelers, you must have their authority, or the authority of their parent or legal guardian where applicable. You must provide them with the relevant booking terms and supplier restrictions before booking.
You are responsible for payments and charges you authorize or expressly agree to pay in your booking documents. Acting as a group contact does not, by itself, make you responsible for another traveler’s payments unless you agree to that responsibility.
Information provided by you or on behalf of your traveling party must be accurate, complete, and current. This includes traveler names as shown on travel documents, dates of birth where required, contact information, and any requirements relevant to the arrangements. Please notify us promptly of changes. Corrections may incur supplier charges or agreed amendment fees.
Travel involving unaccompanied minors must be disclosed before booking and is subject to supplier requirements and our written agreement.
4. Booking and Confirmation
A booking is confirmed only when we issue written confirmation identifying the confirmed arrangements, subject to the payment requirements stated in your booking documents. Proposals, quotations, preliminary itineraries, and inquiries do not constitute confirmed reservations.
Please review your confirmation promptly, including traveler names, dates, accommodation categories, services, and inclusions, and notify us immediately of inaccuracies. We will address errors attributable to us. Corrections arising from inaccurate information you supplied or changes you request may incur charges disclosed before you authorize the correction.
Any arrangements you book independently are outside our agreed services unless expressly included in writing. We do not manage, change, cancel, or obtain refunds for independently booked services unless separately agreed.
5. Pricing, Fees, and Payment
Your proposal or booking documents will state the price, currency, inclusions, exclusions, any applicable charges, and payment schedule. Our planning is included in the full-trip price; we do not charge a separate planning fee. Prices and availability may change before confirmation. Any price adjustment after confirmation must be permitted by the accepted booking conditions and applicable law.
The required deposit will be disclosed before booking. Deposits are nonrefundable unless expressly stated otherwise or required by applicable law. Certain arrangements may require a larger deposit or full payment at booking. Paying in full does not, by itself, determine refund eligibility.
Unless a different deadline is disclosed before booking, the remaining balance is due 60 days before departure. Bookings made within 60 days of departure require full payment at booking. Earlier supplier payment deadlines will be stated in your booking documents.
Payments to LuxeAway are accepted by ACH, wire, or bank transfer unless otherwise agreed in writing. Credit card payments for trip add-ons under US$1,000 may be accepted at our discretion. The invoice will specify the accepted payment method and any applicable payment charges. Payment is received when cleared funds reach the designated account; proof of a transfer does not constitute receipt.
If payment is overdue, we will notify you and explain any available deadline to remedy it. Supplier deadlines may prevent us from holding arrangements while payment remains outstanding. Failure to pay may result in cancellation and the charges disclosed before booking, subject to applicable law.
Any agreed cancellation, processing, amendment, or insurance charges are payable by the deadline stated in the relevant invoice. Final travel documents will generally be provided after full payment and receipt of the necessary information from suppliers.
6. Customer Cancellations and Refunds
Cancellation requests must be submitted in writing. We will acknowledge receipt and communicate the request to the relevant suppliers. Cancellation deadlines and their calculation will follow the conditions disclosed for your booking. If you do not receive an acknowledgment promptly, please contact us again.
Cancellation charges and refund eligibility depend on the arrangements booked and the cancellation terms provided before booking. These may include nonrefundable supplier payments and LuxeAway fees expressly identified as nonrefundable. Your booking documents will specify the applicable deadlines and charges.
We will provide an itemized explanation of deductions and return any refund due to the original payer, generally using the original payment method where practicable. Refund timing may depend on supplier processing, but this does not override any deadline or refund obligation imposed by applicable law.
Refunds or reinstatement of loyalty points, credits, and vouchers are governed by the applicable provider’s terms and applicable law. LuxeAway cannot guarantee their reinstatement. Any refund received by LuxeAway on your behalf will be handled under the applicable booking terms and legal requirements.
7. Customer Changes
Requests to change confirmed arrangements must be submitted in writing. Changes are subject to availability, supplier approval, and applicable booking conditions and cannot be guaranteed.
Before you authorize a change, we will explain any price difference, supplier charge, and LuxeAway amendment fee. Some changes may require cancellation and a new booking. Requests close to departure may be unavailable or subject to higher charges. We will not charge a LuxeAway amendment fee to correct an error attributable to us.
8. Supplier Changes and Cancellations
If a Travel Supplier changes or cancels a confirmed arrangement, we will communicate the change and any available alternatives, credits, or refunds. Your options will depend on the supplier’s terms and applicable law. A supplier-initiated change will not automatically be treated as a voluntary cancellation by you.
If LuxeAway cancels an arrangement for reasons within its control and you do not accept a suitable alternative, we will refund payments collected for the canceled arrangement. This does not automatically cancel separately booked services. Cancellations caused by circumstances beyond our reasonable control are addressed under Section 10, subject to applicable law.
9. Flights
LuxeAway ordinarily provides flight recommendations only. Unless we expressly agree otherwise in writing, flights are not included in our services or trip price, and you are responsible for booking and paying for them directly with the airline or your chosen ticket provider. Recommendations reflect information available when provided; fares, availability, schedules, and airline conditions may change before booking. Please obtain our written confirmation that your land arrangements are confirmed before purchasing flights intended to connect with those arrangements.
For independently booked flights, you are responsible for reviewing and confirming traveler details, airports, dates, connection times, baggage allowances, ticket conditions, and applicable travel-document requirements. LuxeAway does not manage, monitor, change, cancel, or obtain refunds for those bookings unless separately agreed in writing. To the extent permitted by law, LuxeAway is not responsible for airline schedule changes, delays, cancellations, denied boarding, baggage issues, or missed connections outside its control. Nothing in this provision excludes liability for LuxeAway’s own negligence or breach of its agreed obligations, or any liability that cannot lawfully be excluded.
In exceptional cases, LuxeAway may agree in writing to assist with a flight booking. Before purchase, you must approve the itinerary, traveler details, total price, applicable ticket conditions, and any disclosed service fee. Full payment in cleared funds is required before ticket issuance unless LuxeAway expressly agrees otherwise in writing. If LuxeAway agrees to advance payment, reimbursement is due by the deadline specified in that written agreement or, if no deadline is specified, within 24 hours after the invoice is sent. Proof of a transfer does not constitute receipt of payment. Reservations and fares are not guaranteed until ticketed. Failure to pay may result in an unticketed reservation being released; it does not extinguish your obligation to reimburse an authorized purchase already made. Changes, cancellations, and refunds remain subject to the applicable ticket conditions and mandatory law.
10. Circumstances Beyond Our Control
“Force Majeure” means circumstances beyond our reasonable control that prevent or materially affect performance of our obligations, including severe weather, natural disasters, war, civil unrest, terrorism, pandemics, government restrictions, and transportation or infrastructure disruptions.
To the extent permitted by law, LuxeAway will not be liable for delay or failure to perform an obligation to the extent caused by Force Majeure. We will notify you as soon as reasonably practicable and take reasonable steps to mitigate its effect on our services.
Changes, cancellations, credits, and refunds will be handled under the applicable booking and supplier terms, subject to mandatory legal rights. We will make reasonable efforts to recover refundable supplier payments and pass on amounts due to you. Force Majeure does not make refund decisions solely discretionary or remove any refund obligation imposed by law.
11. Special Requirements and Requests
Please disclose any accessibility needs, dietary requirements, medical-related travel requirements, or other essential requests before booking. We will communicate these to the relevant suppliers and tell you whether they have been confirmed. A request is not guaranteed unless expressly confirmed in writing. If a requirement is essential to your decision to travel, do not authorize the booking until its status has been clarified.
Supplier restrictions may apply to particular activities or arrangements, including age, fitness, mobility, weight, or medical requirements. You are responsible for providing accurate information relevant to those requirements. We cannot assess medical fitness or guarantee that every service can accommodate every request.
12. Travel Insurance
We strongly recommend appropriate travel insurance covering cancellation, interruption, medical treatment, emergency evacuation, and repatriation, together with any additional coverage appropriate to your activities and itinerary. Certain destinations or suppliers may require evidence of specified coverage.
You are responsible for selecting suitable insurance and reviewing its coverage, exclusions, limits, and claim requirements. Unless separately agreed in writing, arranging travel does not include purchasing insurance. Choosing not to obtain insurance does not expand LuxeAway’s obligations or reduce any rights you have under applicable law.
13. Travel Supplier Terms and Conduct
Travel Suppliers are independent businesses responsible for delivering their own services. Your arrangements are also subject to their booking conditions, cancellation policies, and service restrictions, which will be provided or identified before booking. Their privacy policies explain how they handle your personal information.
Travelers must comply with applicable laws, supplier rules, and reasonable safety instructions and behave respectfully toward other guests and service providers. Some activities may require a separate supplier waiver or participation agreement, which you should review before accepting.
Violating supplier rules may result in denied services, cancellation, or forfeiture of payments under the applicable supplier terms. You may also be responsible for documented costs arising from your own violation, subject to applicable law. We will explain any such charges before requesting payment.
14. Travel Documents, Entry Requirements, and Safety
Each traveler, including children, must hold the passports, visas, transit permissions, and other documents required for their nationality and itinerary. Passport validity and blank-page requirements vary by destination and transit country. You are responsible for confirming requirements with official authorities and obtaining the necessary documents, including any required consent documents for minors.
Unless expressly included in our agreed services, LuxeAway does not obtain travel documents on your behalf. General information we provide should be verified with the relevant official authorities. Entry requirements may change, and admission remains subject to the decisions of border authorities. This does not exclude liability for our own errors where applicable law provides otherwise.
Travel involves risks that vary by destination and activity. Offering an itinerary does not guarantee that a destination is free of risk. Please review current government travel advisories and relevant safety information before booking and departure.
LuxeAway is not a medical advisor and cannot determine your health or fitness for travel. Consult an appropriate healthcare professional about your itinerary, medical history, vaccinations, medications, and activity requirements. You are responsible for meeting applicable health entry requirements.
In an immediate emergency, contact local emergency services first. Use the supplier and LuxeAway contact details provided in your travel documents for coordination assistance. Any support availability will be specified in your booking documents; our services do not replace emergency response services.
15. Liability
LuxeAway remains responsible for its own agreed advisory and booking obligations. Travel Suppliers are independent businesses and are not employees of LuxeAway. To the extent permitted by applicable law, we are not responsible for supplier acts, omissions, or failures outside our control.
To the extent permitted by applicable law, LuxeAway’s aggregate liability arising from a particular booking will not exceed the total amount paid to LuxeAway for that booking. This limitation does not limit any obligation to return funds or provide a refund required by law and does not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot lawfully be limited.
Nothing in these Terms excludes or restricts mandatory consumer protections, statutory remedies, or other rights that cannot lawfully be waived.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify LuxeAway and its officers, employees, and agents against third-party claims and reasonable related costs to the extent caused by your unlawful conduct or material breach of these Terms. This obligation does not apply to the extent a claim results from LuxeAway’s own negligence, misconduct, or breach of its obligations.
17. Privacy and Communications
Our Privacy Policy explains how we collect, use, and share personal information. Please review it before submitting an inquiry or providing traveler information. Where separate consent is required for a particular use of your information, we will request it separately.
When you submit an inquiry or engage our services, we may contact you using the details you provide to respond to your request and coordinate your travel arrangements. Marketing communications and communications requiring separate consent will be handled separately. You may request a different communication method or unsubscribe from marketing messages at any time.
18. Website Use and Intellectual Property
You must not use our website for unlawful purposes, submit fraudulent inquiries, provide knowingly false information, interfere with website security, or request fraudulent reservations or reservations without a genuine intention to travel.
Website content owned by LuxeAway, including original text, designs, and branding, is protected by applicable intellectual property laws. You may view and use it for personal travel planning but may not reproduce or distribute it commercially without permission. Third-party content remains the property of its respective owners.
Links to third-party websites and itinerary platforms are provided for convenience. Those services operate under their own terms and privacy policies. A link does not guarantee the accuracy or availability of third-party content.
19. Concerns, Governing Law, and Disputes
Please report concerns promptly so we have an opportunity to address them. Nothing in these Terms shortens an applicable statutory limitation period or requires you to forfeit a claim merely because you did not report it within a particular period.
These Terms are governed by Florida law, except where mandatory applicable law provides otherwise. Subject to any mandatory rights concerning jurisdiction or venue, disputes arising from these Terms or our services will be brought in a court of competent jurisdiction in Miami-Dade County, Florida. Nothing in this provision prevents a complaint to a regulator or the exercise of a right that cannot lawfully be restricted.
20. Entire Agreement and Severability
These Terms, together with your accepted proposal, booking confirmation, and additional terms expressly incorporated into your booking, form the agreement between you and LuxeAway for the relevant services. Any booking-specific variation to these Terms must be expressly agreed in writing. Supplier terms govern the services supplied by the relevant supplier, subject to applicable law.
If a provision is found invalid or unenforceable, it will be severed to the extent necessary, and the remaining provisions will continue in effect. Any failure to enforce a provision on one occasion does not waive the right to enforce it subsequently.
